How Our Probate Process Works

We publish a Notice of Intention to apply for Probate 

The Notice of Intention is some standardised wording naming the deceased and the executors. We'll draft it and place it on your behalf.  14 days after the Notice runs, your Probate application can be lodged.  Note that for Western Australia, there is no requirement to place a Notice of Intention.

We'll prepare your entire Probate or Letters of Administration application

All we'll need from you is some fairly  basic information, including the details of assets are held by the deceased. Each state is different, but we will discuss with you specifically what details we need for your application.


We'll show you exactly how the various documents need to be signed

Via signature required Registered Mail we will post the documents to you for signing, and of course go through the documents with you over the phone in advance.  In most states there are 4-5 documents to be signed, so not a great deal of paperwork. We also include a  return addressed Registered Mail pack for the documents to returned to us in. that you just need to lodge over the counter at any post office. We will then lodge everything with the Supreme Court in your state.

The time it takes for the Court to approve your application varies somewhat state to state and also depends on how busy the Court is.  As an example, probate applications in Victoria take no more than around 15 days to be approved, whilst in Queensland they can take up to about 12 weeks at present to be approved.
