Queensland Probate Costs

In Queensland there are 3 costs associated with obtaining a grant of Probate.  The first 2 are Court charges, the third is the fee you pay the company or individual who prepares the paperwork that is submitted to the Court.


Court Charge 1: Publishing a Notice of Intention to apply for a grant of Probate

The current Court charge in Queensland for publishing the notice is $161.70  The notice runs for 14 days  on the Queensland Law Reporter website. It contains some standard wording and is designed to state on the public record that an application for a grant of Probate will be made.  It includes the name of the deceased and the name of the executor(s) named in the will.  An example of what the notice looks like is below


SMITH, JOHN ALAN


After 14 days from today an application for a grant Letters of administration on intestacy of JOHN ALAN SMITH late of 123 Example St Brisbane QLD 4000 , deceased, will be made by SUSAN KATE SMITH at the Supreme Court at Brisbane. You may object to the grant by lodging a caveat in that registry. Any person having any claim whether as creditor or beneficiary or otherwise must send particulars of the person’s claim to the Applicant’s representatives (identified below) not later than the date which is 6 weeks after the date of publication of this Notice, after which date, pursuant to s.67 of the Trusts Act 1973, the Applicant will distribute the Estate of the Deceased having regard only to the claims of which the Applicant has notice.

Court Charge 2: The Probate Filing Fee

This is a the charge imposed by the Supreme Court in order to lodge an application for Probate in Queensland.  Unlike most other states in Australia, the filing fee is not based on the total value of the assets held by the deceased.  Regardless of the value of the estate, the Probate filing fee in Queensland is $748.10.  



Cost 3: The Fee charged by the company who prepares your Probate application

Solicitors and Law Firms will generally charge you anywhere between $2,000 and $10,000 to prepare the paperwork for your application.  The majority of them base their fees on the value of the assets held be deceased.  At Making Probate Easy our fee is $800, regardless of the value of the estate.  And we guarantee your Probate application will be approved by the Court.
